Purchasing and Pre-ordering from Toy Trash - Terms and Conditions

These Terms and Conditions (“Terms”) apply when you purchase or pre-order a product from Toy Trash UK, whether it’s online or through any other methods. By purchasing an item or placing a pre-order you’re agreeing to be bound by these Terms, so please read them carefully before you make a purchase or place a pre-order and keep a copy for your records.

Placing a pre-order

  1. Pre-released orders (“Pre-orders”) are orders for products (“Products”) that are not yet available for general sale from Toy Trash UK

  2. In order to place a Pre-order you will need to provide certain information, including but not limited to your name, address, e-mail address and billing information. It is your responsibility to make sure this information is accurate and up to date. If we do not have accurate information we will not be able to inform you when the Pre-order is available for purchase or refund any Pre-order payments, if applicable.

  3. Products are subject to price fluctuations with manufacturers and suppliers reserving the right to change the price of any product at any time. In the rare circumstance a product is affected by a price change, customers will be notified by email prior to being sent remaining balance invoices and the additional cost will be collected via a separate invoice sent to the customers PayPal.

 

Payments

  1. We only accept PayPal payments for all purchases and pre-order placements. If customers wish to pay for their items via bank transfer or cash they are advised to contact us.

  2. All purchases are made in GBP £ Sterling. Any conversion will be done by the payment method customers choose to pay with. We have no control over exchange rates, or any fees that a customer’s card/account provider may charge.

  3. When you make a purchase or place a pre-order you will need to pay the full upfront price of the Product or you may be asked to pay a deposit (“Pre-order Payment”).

  4. All purchases and pre-orders carry a 10% non-refundable deposit.

  5. If a full payment is made and the buyer wishes to cancel a purchase or a pre-order, we will refund 90% of the total amount.

  6. Deposits are as stated, non-refundable; the exception to this being where an item is cancelled from production, delayed significantly past the point of other UK online retailers stocking them or where a significant increase in price has been applied. Please see below for details on cancellations and delays to pre-orders as well as Pre-Order Price Changes. When a pre-order is made on an item, it is ordered in specifically for the buyer and prioritised.

Delivery & Cancellation

  1. Where possible orders will be shipped to you or be ready for collection as soon as is practicable, subject to availability, in order that you may receive it on the release date. For some areas delivery will take longer.

  2. Release dates are decided by the manufacturers and are subject to change. As a result, we cannot be liable for any changes to Release dates or Pre-order windows advertised by us.

  3. Cancellations of a purchase or Pre-order will be subject to fee of 10% on the value of the item(s) purchased.

  4. Toy Trash UK may cancel a Pre-order at any time for any or no reason prior to our notice to you that the Product has been dispatched or is ready for collection (“Dispatch Notice”). If cancellation occurs before the Dispatch Notice, you will be entitled to a full refund of your Pre-order Payment.

International shipping policy

  1. International buyers are responsible for any fees, duty, taxes or customs that may apply within their resident country. Our items are declared at their correct sale value as legally required.

  2. International customers should place pre-orders and orders for in stock items separately,

  3. this will reduce the chance of overpaying on shipping as the estimated weight of any pre-ordered items will be added to the total and affect the automated shipping estimate for the order.

  4. Where in stock and pre-orders are placed together the buyer will be invoiced for the shipping of any pre-order items as any and all of them arrive to us for processing and shipping, this is in addition to the shipping charged to send their in stock items at time of order.

  5. At the moment when placing a pre-order with full payment the applicable shipping is automatically added to the order and will of course be honoured on arrival of the product and any final balances owed will be adjusted accordingly.

  6. If any of the above is unsuitable but you still wish to make a pre-order, please contact us to discuss your needs.

  7. International customers should purchase confidently and in normal cases the shipping charged will be accurate for the items purchased. Unfortunately the costs of shipping internationally fluctuate daily and are subject to additional costs based on but not limited to: weight; volumetric weight; actual size/dimensions; destination and value.

  8. For pre-ordered items the weights and dimensions may also change from original specifications we receive, potentially altering shipping costs when they arrive.

  9. We use standard methods of shipping internationally, using either trackable courier or Royal Mail. These may then be passed to a 3rd party/ the receiving country’s local service. We default to the most economical option for the customer depending on a number of factors including location, item value and weight/dimensions.

  10. International buyers are asked to wait 10-20 business days for delivery depending on country and shipping method, in many cases this can be sooner but if you have any concerns please contact us.

  11. We endeavour to post all items within 48 hours of orders being placed, generally sooner, any severe delays to this will be communicated to the e-mail address/ contact information provided to us at time of purchase. Please allow additional delivery time over public holidays.

  12. We are happy to post items using other methods on request. The buyer is responsible for any additional charges this may incur but only in addition to the cost of our standard shipping method included in our prices.

  13. Items are insured at the standard rate of £20 per package. In the event that parcels become lost or damaged as a result of incorrect delivery addresses/ instructions being provided to us this will be the maximum we will be able to reimburse. Buyers are welcome to contact us about purchasing additional insurance.

  14. If a package appears to have become lost as a result of courier/ postal service behaviour please contact us immediately so we can more promptly issue a refund/ replacement. See Returns and Refunds for more information. In most cases we will only be able to refund the amount of insurance but we are happy to work on a case by case basis where the buyer has purchased additional insurance or signature requirement. Please be aware that specific or unique delivery instructions can and should be communicated to us prior to us shipping.

UK shipping policy

  1. Our prices include free UK recorded delivery via royal mail 48 on all collectables and non-published items. Buyers can expect 2-4 days for delivery of in-stock items. Buyers are welcome to request and purchase alternative or expedited shipping methods.

  2. We endeavour to post all items within 48 hours of orders being placed, generally sooner; any severe delays to this will be communicated to the e-mail address/contact information provided to us at time of purchase. Please allow additional delivery time over public holidays.

  3. We are happy to post items using other methods on request. The buyer is responsible for any additional charges this may incur, but only in addition to the cost of our standard shipping method included in our prices.

  4. Items are insured at the standard rate of £20 per package. In the event that parcels become lost or damaged as a result of incorrect delivery addresses/instructions being provided to us, this will be the maximum we will be able to reimburse. Buyers are welcome to contact us about purchasing additional insurance.

  5. If a package appears to have become lost as a result of postal service's behaviour, please contact us immediately so we can more promptly issue a refund/replacement. In most cases, we will only be able to refund the amount of insurance but we are happy to work on a case by case basis where the buyer has purchased additional insurance or signature requirement.

  6. The majority of our items are shipped with the requirement for a signature. In cases of items being left in inappropriate places/with neighbours, please ensure you have entered any special instructions for delivery at checkout and use the tracking number where applicable to ensure you receive your items promptly.

 

Returns & refunds

 

We try our best to ensure customer satisfaction for every item purchased, but sometimes things can go wrong. If at any time you are unhappy with your purchase, please refer to the relevant processes below and contact us.

  1. We offer a 14-day refund policy on return of the item if an order is made by mistake, or a customer no longer wants the item they have purchased,
  2. The item must be unused and unopened and returned to us in the condition it was sent in. Customers will need to cover the return costs.
  3. If an item is defective or has been damaged in transit, we will offer a replacement for the item or a replacement part so long as the item is still available on our store, with our supplier or if a replacement part can be sourced with the manufacturer.
  4. The return for defective or damaged items must be completed within 14 days of purchase.
  5. If a replacement or replacement part can not be sourced a partial or full refund will be offered.
  6. We will cover all return costs including sending of any replacements for defective or damaged items.
  7. The defective product must be returned and we may ask for photographic evidence of how it was received to provide to our suppliers/manufacturer/postal service provider.
  8. Item packaging condition and cosmetic paint application issues or minor functionality complaints do not count as defective or damaged items.
  9. A return will not be accepted for any item that has been damaged after prolonged use by the customer.
  10. Refunds are made to the original payment method used for the product.
  11. We will issue a refund upon return and inspection of the item(s). We are not responsible for items lost or damaged in return transit and this may affect the level of your refund.
  12. Please allow 3-5 days for a refund to be processed. Paypal state it may take up to 30 days for a visible refund to appear.
  13. We are not responsible if an item is undeliverable due to an address error from the customer or if the customer is not available to accept the delivery.
  14. If an item has been returned to us by the courier due the item not being able to be delivered and the customer has not contacted us, your order will be cancelled.
  15. If a customer contacts us regarding an undeliverable item, we will resend the item to the same or an alternative address with the customer responsible for the additional postage charges. 
  16. International customers are responsible for all additional customs, duty/tax fees for refused or undeliverable items. If your item is rejected at customs, no refund will be issued for items or postage.
  17. If a package appears to have become lost please contact us immediately.
  18. We will only be able to refund up to the amount insured (standard is £20), but we are happy to work on a case by case basis where the buyer has purchased additional insurance or signature requirement.

These Terms are governed construed according to English law. Any disputes or proceedings shall be subject to the exclusive jurisdiction of the English Courts.by English law.
